Auction One Garden Route – Online Bidding Terms & Conditions

By registering to bid, you agree to the following:

  1. Registration & Deposit
  • All bidders must register and provide ID & proof of address (FICA compliance).
  • Online bidders pay a R10,000 refundable deposit, applied to the purchase price if successful.
  • Bidding on behalf of another requires a letter of authority or Power of Attorney.
  1. Property Sale
  • The property is sold as-is (“voetstoots”), including size, title, zoning, and municipal compliance.
  • Purchasers acknowledge having inspected the property and accept it in its current condition.
  1. Auction Process
  • The auction starts at the advertised time and will not be delayed.
  • The Auctioneer may accept or reject any bid.
  • Disputes will be resolved by re-auction, and the Auctioneer’s decision is final.
  • Highest bid is subject to Sellers Acceptance.
  1. Payment & Transfer
  • 10% deposit + 10% commission payable immediately after the auction.
  • Balance guaranteed within 14 days of confirmation.
  • Transfer and occupation occur upon registration; Seller provides vacant occupation.
  1. Costs
  • Purchaser pays transfer duty/VAT, conveyancing fees, bond costs, stamp duty, and a pro-rata share of rates and taxes.
  1. Legal & Compliance
  • Purchaser acknowledges all zoning, planning, and legal requirements.
  • Property is sold without warranty for suitability.
  • Purchaser submits to the jurisdiction of the Magistrate’s Court.
  1. Documentation
  •  Seller Property Disclosure and Auction One Privacy Policy available on request.
  • Full Conditions of sale available on request.
  • Auctioneers reserves the right to amend the Conditions of Sale up until the date of the auction.

Right of Access and Removal

The Seller and/or Auctioneer reserves the right to refuse or withdraw access to the property, or require any person to leave the premises, at their sole discretion, for any reason, including but not limited to safety, security, or compliance with auction procedures. By attending or accessing the property, you acknowledge and accept this right.
